THE Court of Appeal has sentenced a man to one year in jail for possessing an unlicensed firearm and some ammunition.
The man was first convicted by the Criminal Court after a police patrol arrested him with firearm and live ammunition.
He later confessed to the ownership of firearm and was sentenced to three years imprisonment and a fine of QR10,000.
The accused then appealed the verdict and the Court of Appeal listened to his argument and accepted the appeal. Citing Article 93 of the Qatari Penal Code, the court decided to reduce the verdict to one year suspended imprisonment without the fine. The court believed that the accused would not repeat such an offence in the future.
Article 93 of the Qatari Penal Code says that should the court consider, when sentencing for a misdemeanour that the circumstances of the offence or the perpetrator require mercy, it may reduce the penalty if there is a minimum limit for the penalty, the court may not comply therewith. It can also be reduced if the penalty is imprisonment and a fine together, the court shall impose one of them only. The Article also says that if the penalty is imprisonment without a minimum term limit, the court may apply a fine not exceeding QR5,000.
