Members of the European Parliament want the European Commission to use new sanction powers against Poland and Hungary after their governments’ legal defeat at the European Court of Justice (ECJ) on Thursday.
“The advocate general’s opinion is a victory for the European Parliament. Now, there is no excuse left for the European Commission to apply the regulation,” Hungarian MEP Katalin Cseh said in a tweet.
Dutch MEP Sophie in’t Veld tweeted only “a lack of political courage” prevents European Commission President Ursula Von der Leyen from acting.
The court’s advocate general recommended Warsaw and Budapest’s legal objections to the sanction powers against rule-of-law violations should be dismissed. The initial decision is not binding but is a strong indication for the ECJ’s final ruling.   It follows a years-long struggle between Poland and Hungary and the commission over democratic backsliding and the primacy of EU regulations.
