The Emir HH Sheikh Tamim bin Hamad al Thani on Sunday ratified the Cabinet Decision No. 6 of 2018 on forming committees to resolve labour disputes, rules and procedures to be followed before the committee and the mechanism for implementing decisions and determining emoluments of the members of the committees.
The law is effective from the following day of its publication in the Official Gazette.
This is in line with Qatar's efforts to preserve labour rights and simplify litigation procedures in labour disputes.
The Cabinet decision includes provisions on forming committees to settle labour disputes and their work scope, the conditions that require the management concerned to refer the dispute between the employer and employee to the labour dispute resolution committee.
The decision also includes provisions on the grace period during which the management refers the dispute to the committee, the method and procedures of referrals, the appeal to cancel penalty imposed on the employee, the determination period for the first hearing of the dispute, notifying the parties to the dispute to appearing before the committee, dispute resolution procedures, notifying both parties of the procedures and decisions issued by the committee.
As per the Cabinet decision, one or more committees called"Labour Dispute Settlement" Committee will be established by the Ministry of Administrative Development, Labour and Social Affairs.
The committee will be the sole authority to adjudicate all individual disputes.
The committee will decide on the dispute before it within three weeks from the date on which it is submitted. Members of the committee shall be independent and won't be answerable to any other authority for their decisions other than the law.
No person or entity may intervene in the arbitrations of the disputes by the committee. Decisions of the committee shall be issued with accelerated access.
